Subscribe and Win Terms and Conditions for Customers
1. Introduction
By participating in the “Subscribe and Win” program on Smartbazaar, you agree to be bound by the following terms and conditions. Please read them carefully.
2. Eligibility
- The “Subscribe and Win” program is open to all customers for free who subscribe to any vendor’s VirtualStore on Smartbazaar.
- Participants must be at least 18 years old to be eligible for prizes.
3. How to Participate
- To participate, customers must subscribe to a vendor’s VirtualStore on Smartbazaar.
- Each subscription grants the customer five “try again” chances daily to win prizes.
4. Prizes
- Smartbazaar will not directly provide the prizes. Prizes shall be sponsored by Smartbazaar vendors and sponsors.
- Prizes may include gifts, store discount vouchers, or other promotional items.
- The type and number of prizes are displayed in Subscribe & Win Portal and are subjected to change without prior notice
5. Daily Chances
- Customers receive five chances daily to participate in the “Subscribe and Win” program.
- Unused chances do not carry over to the next day.
6. Prize Redemption and Publication of Winners
- Winners will be notified through the Smartbazaar app and via email.
- Prizes must be claimed within 30 days of notification. Failure to do so may result in forfeiture of the prize.
- Prizes are non-transferable and cannot be exchanged for cash.
- The names of winners shall be published on Smartbazaar’s platform, including the website, app, Facebook page, etc.
7. Use of Customer Information
- By participating in the program, customers consent to the collection and use of their personal information (name, address, mobile number, date of birth, email, gender, and username) for marketing, promotional, and advertising purposes by Smartbazaar.
- Smartbazaar may share customer information with vendors for the purpose of fulfilling the program requirements.
- Customer information will be stored on servers located outside Nepal.
8. Communication with Vendors
- If customers communicate or make purchases directly with vendors through phone, WhatsApp, message, or Viber, the vendor will have access to the customer’s mobile number.
- Smartbazaar is not responsible for any unwanted callbacks or communications from vendors.
9. Disclaimer
- Smartbazaar is not responsible for any technical issues or errors that may occur during participation in the program.
- Smartbazaar reserves the right to modify or terminate the program at any time without prior notice.
10. Limitation of Liability
- Smartbazaar shall not be liable for any damages, losses, or expenses arising out of or in connection with the program.
- Participation in the program is at the customer’s own risk.
11. Tax
- In order to claim the prize won, the winner must pay a 13% tax on the value of the prize as per Government Policy.
12. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of Nepal.
- Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Nepal.
13. Acceptance of Terms
- By participating in the “Subscribe and Win” program, customers signify their acceptance of these terms and conditions.
