Smartbazaar Terms and Conditions for Users & Buyers
Introduction
Welcome to Smartbazaar. These Terms and Conditions ("Terms") govern your use of our platform, including our website and mobile application ("Platform"). By accessing or using Smartbazaar, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.
Account Registration
1. Eligibility: To use our Platform, you must be at least 18 years old and capable of forming a binding contract.
2. Account Creation: You are required to create an account to access certain features of the Platform. You must provide accurate and complete information and keep your account information updated.
3. Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account. Smartbazaar is not liable for any losses caused by unauthorized use of your account.
Use of the Platform
1. Permitted Use: You may use the Platform for lawful purposes and in accordance with these Terms.
2. Prohibited Use: You agree not to use the Platform for any illegal or unauthorized purpose. You also agree not to interfere with the operation of the Platform, including but not limited to transmitting any worms or viruses or any code of a destructive nature.
Purchases
1. Product Listings: Sellers list their products and services on Smartbazaar. We do not guarantee the accuracy, quality, or legality of these listings. Smartbazaar is a facilitator and not the direct seller of the listed products and services.
2. Making a Purchase: You can make purchases directly through the Platform using the "Buy Now" feature. Smartbazaar facilitates the transaction between buyers and sellers and provides a secure payment gateway for these transactions.
3. Direct Contact with Sellers: Buyers can contact sellers directly via WhatsApp, phone, Viber, or other provided communication tools to gather information or arrange purchases. Any transactions or communications conducted outside of the Platform are the sole responsibility of the buyer and seller.
Disclaimer and Limitation of Liability
1. Transactions with Sellers: Smartbazaar is not responsible or liable for any transactions, communications, or dealings between buyers and sellers that occur outside of the Platform. This includes, but is not limited to, purchases arranged directly with sellers and any information received from sellers.
2. No Warranty: Smartbazaar does not warrant or guarantee the quality, safety, legality, or accuracy of any products, services, or information provided by sellers. Warranty terms vary by product and vendor and are detailed on the product detail page. All purchases made through direct contact with sellers are at your own risk.
3. Platform Use: Smartbazaar provides the Platform "as is" and "as available." We make no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, materials, or products included on the Platform. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Delivery and Returns
1. Delivery: For purchases made through the Platform, Smartbazaar provides delivery services through our logistics partners. Delivery terms and conditions vary by seller, and delivery times are estimates and not guarantees.
2. Returns and Refunds: Each seller has their own return and refund policy. Please refer to the specific seller’s policy before making a purchase. Smartbazaar is not responsible for the enforcement of seller-specific return and refund policies.
Warranties
1. Product Warranties: Warranty terms vary by product and vendor. The specific warranty details for each product are provided on the product detail page. Buyers are advised to review the warranty information before making a purchase.
Advertising and Promotions
1. In-App Advertising: Sellers can promote their products and services through in-app advertising.
2. Exchange Adboost: Sellers can advertise by offering their products, services, or deals instead of cash.
Intellectual Property
1. Ownership: All content on the Platform, including text, graphics, logos, images, and software, is the property of Smartbazaar or its content suppliers and is protected by intellectual property laws.
2. License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal and non-commercial use.
User-Generated Content
1. Responsibility: Users may post reviews, comments, and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties.
Privacy and Data Usage
1. Personal Information: By using Smartbazaar, you consent to the collection, storage, and use of your personal information, including your name, address, mobile number, date of birth, email, gender, and username. This information may be used for marketing, promotional, and advertising purposes.
2. Data Storage: Your information and data will be stored on servers located outside of Nepal. By using Smartbazaar, you consent to this transfer, storage, and processing of your information in a location outside of Nepal.
3. Third-Party Access: If you communicate with or make purchases from sellers directly (through phone, WhatsApp, message, or Viber), the seller will have access to your contact information, including your mobile number. Smartbazaar is not responsible for any unwanted callbacks or communications you may receive as a result.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
Changes to Terms
Smartbazaar reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following the posting of changes constitutes your acceptance of such changes.
Breach of Terms
1. Consequences of Breach: If you fail to comply with these Terms, Smartbazaar reserves the right to take any or all of the following actions:
- Immediate termination or suspension of your account without notice.
- Legal action against you for any damages resulting from your breach.
- Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
2. Indemnification: You agree to indemnify and hold Smartbazaar, its affiliates, officers, directors, employees, agents, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
